Man out on parole charged with a long list of offences – Lake Macquarie

Case Summary:

A man wanted on an outstanding warrant has been charged with more than 20 offences after he was arrested in the state’s Hunter Region.


Offender:

  • 24 year-old man on parole

Crime and Charges:

  • Dishonestly obtain property by deception (x5)
  • Drive conveyance taken without consent of owner (x7)
  • Drive motor vehicle during disqualification period (x3)
  • Police pursuit – not stop – drive recklessly (x2)
  • Goods in personal custody suspected being stolen (not motor vehicle)
  • Goods suspected stolen given other not entitled (not motor vehicle)
  • Use offensive weapon to prevent lawful detention
  • Not give particulars to other driver
  • Custody of knife in public place
  • Larceny
  • Shoplifting (x2)


Bail and Court Dates:

  • The man was refused bail to appear before Newcastle Bail Court today (Sunday 27 September 2020).

Police will allege:

Police will allege in court that the offences were committed across the Lake Macquarie, Tuggerah Lakes, Brisbane Water and Newcastle City Police Districts since May 2020.

Maximum penalty

Dishonestly obtain property by deception:

The maximum penalty is imprisonment for 10 years where the case is finalised in the District Court, or 2 years where it is dealt with in the Local Court.

Drive conveyance taken without consent of owner:

The maximum penalty for this offence is 5-years imprisonment if it ends up being dealt with in the District Court or 2 years where it is dealt with in the Local Court.

Drive motor vehicle during disqualification period:

The maximum penalty for this offence is fine of $5,500 or 12 months imprisonment

Goods suspected stolen given other not entitled (not motor vehicle):

The maximum penalty for this offence is 6 months imprisonment

Use offensive weapon to prevent lawful detention:

The maximum penalty is imprisonment for 12 years.

Police Pursuit

For offenders of Police Pursuit, the maximum penalties are:
(a) in the case of a first offence–imprisonment for 3 years, or
(b) in the case of an offence on a second or subsequent occasion–imprisonment for 5 years.

Custody of knife in public place:

In NSW, being in custody of a knife in a public place or a school is an offence that carries a maximum penalty of 2 years imprisonment and or fines of up to 20 penalty units.

Larceny:

Where the value of the property does not exceed $2,000, the maximum penalty that may be imposed is a fine of $2,200. Where the property exceeds $2,000 but does not exceed $5,000, the maximum penalty that may be imposed is twelve months imprisonment or a fine of $5,500. If the property exceeds $5,000, the maximum penalty that may be imposed is two years imprisonment.
